2025 Cannabis Legalization Under a New Presidency

As the United States transitions into 2025 under President Donald Trump's renewed leadership, the trajectory of cannabis legalization is poised for significant developments. 

President Trump's stance on cannabis has evolved over time, reflecting both support and caution. In this blog, we’ll explore the anticipated laws and regulations this new administration may implement concerning safe and legal cannabis.

Rescheduling Cannabis

In May 2024, under the Biden Administration, the Department of Justice proposed reclassifying marijuana from Schedule I to Schedule III of the Controlled Substances Act. This change, supported by the Department of Health and Human Services, acknowledges marijuana’s medical use and lower potential for abuse compared to Schedule I and II substances. 

This reclassification could improve access to banking, insurance, and tax benefits for cannabis businesses, reducing financial burdens like IRS Code Section 280E and fostering industry growth.

Trump has also expressed support for the SAFE Banking Act, which would grant cannabis businesses access to financial services, reduce the risks of cash-only operations, and enable affordable lending. These potential shifts could mark a transformative period for the cannabis industry.

State Autonomy & Legalization

President Trump has consistently expressed support for a state's rights approach to cannabis policy. He has indicated that states with legalized cannabis—whether for medical or recreational use—should not face federal intervention. 

This perspective suggests that under his administration, the federal government may allow states to determine their cannabis laws without interference. 

Support for Medical Cannabis

Throughout his political career, President Trump has shown support for medical cannabis. He has emphasized the importance of research to unlock the medical uses of marijuana and has suggested rescheduling it to facilitate such studies. This focus on medical applications indicates a potential for expanded federal support for medical cannabis programs and research initiatives. 

Potential Challenges & Considerations

Despite these supportive signals, there are areas of caution. In his previous term, the administration reversed policies that had discouraged federal prosecution of marijuana cases in states where it was legal. Additionally, budget proposals have removed protections for state medical marijuana laws from federal interference. These actions highlight a complex and sometimes contradictory approach to cannabis policy. 

Industry & Public Response

The cannabis industry has responded to these developments with cautious optimism. Major cannabis companies have united to form the U.S. Cannabis Roundtable, aiming to advocate for federal reforms, including rescheduling cannabis and improving banking access for cannabis businesses. This collective effort reflects the industry's readiness to influence the administration to shape favorable policies. 

Public opinion also plays a crucial role. A Pew Research poll from earlier this year found that more than half of Republicans under 50 support legalizing both medical and recreational marijuana. This shift in voter attitudes may influence the administration's policy decisions and legislative priorities.
